Business Innovation & Investment Visas (Subclass 188/888)
Who Is It For?
Business Innovation and Investment (Provisional) Visa (Subclass 188): This visa allows you to own and manage a business in Australia, conduct business and investment activity in Australia or undertake an entrepreneurial activity in Australia.
Business Innovation and Investment (Permanent) Visa (Subclass 888): for entrepreneurs, investors and business owners to continue their activity in Australia.
Basic Eligibility
- Subclass 188: submit and expression of interest (EOI) in SkillSelect, be nominated by a State or Territory government agency or Austrade, and be invited to apply for the visa.
- Subclass 888: hold a relevant stream of the subclass 188 visa or in relation to applications for a subclass 888 visa in the Business Innovation stream, hold a relevant stream of the subclass 188 visa, or a subclass 444 (Special Category) visa, or a subclass 457 (Business (Long Stay)) visa granted in certain circumstances.

Business Innovation Stream (Provisional) (Subclass 188)
This provisional visa is for people with business skills. It lets you operate a new or existing business in Australia. You must:
- Score at least 65 on the points test.
- Provide proof of your business success (annual turnover, ownership interest).
- You, your partner, or you and your partner together, have total net business and personal assets of at least:
- AUD1.25 million if you were invited to apply for this visa on or after 1 July 2021.
- AUD800,000 if you were invited to apply for this visa before 1 July 2021.
With This Visa You Can
- Operate a new or existing business in Australia.
- Stay in Australia for up to 5 years.
- Bring eligible members of your family with you.
- Apply for a permanent Business Innovation and Investment (Permanent) visa (subclass 888) in the Business Innovation stream if certain requirements are met.
Overview
This is a provisional visa. You can stay in Australia for up to 5 years if you were invited to apply for this visa on or after 1 July 2021. If you applied after 1 July 2015, and were invited to apply for this visa before 1 July 2021, you can stay in Australia for up to 4 years and 3 months. The visa is granted with multiple entries. You can leave and re-enter Australia as many times as you want while the visa is valid.
AUD6,270.00 for the main applicant. There is also a charge for each family member who applies for the visa with you:
- Additional applicant over 18 years old: AUD3,135.00
- Additional applicant under 18 years old: AUD1,565.00
The second instalment charges are:
- Main applicant- AUD9795.00
- Family members- AUD4890.00

You can be in or outside Australia when you apply for the visa and when a decision is made on your application, but not in immigration clearance.

- First, you must submit and Expression of Interest (EOI). If an Australian State or Territory government agency accepts your EOI and nominates you, we will invite you to apply for this visa.
- You must be nominated by an Australian State or Territory government agency, before being invited to apply for this visa.
- For 2 out of 4 fiscal years immediately before you receive an invitation to apply, you must have had an ownership stake in 1 or 2 businesses that had at least:
- AUD500,000 turnover in each of those 2 years if you were invited to apply before 1 July 2021.
- AUD750,000 turnover in each of those 2 years if you were invited to apply on or after 1 July 2021.
- Whether you have 1 or 2 businesses, you must own at least:
- 51%, of the total value of the business if the business has a turnover of less than AUD400,000 per year.
- 30%, of the total value of the business if the business has a turnover of AUD400,000 or more per year, or
- 10%, of the total value of the business if the business is operated by a publicly listed company.
- When you are invited to apply for this visa, you, your partner, or you and your partner combined must have total net business and personal assets of at least:
- AUD1.25 million if you were invited to apply on or after 1 July 2021.
- AUD800,000 if you were invited to apply before 1 July 2021.
- Your funds must be available to transfer to Australia within 2 years of us granting the visa.
- You must score at least 65 points on the points test.

Investor Stream (Provisional) (Subclass 188)
This provisional visa requires you to invest at least AUD2.5 million in Australian investments that meet certain requirements and maintain business or investment activity in Australia. You must:
- Be nominated by a State or Territory government agency to invest at least-
- AUD2.5 million that meets certain requirements if you were invited to apply on or after 1 July 2021.
- AUD1.5 million in an Australian State or Territory if you were invited to apply before 1 July 2021.
- Score at least 65 on the points test.
- Have net business, investment and personal assets of at least AUD2.5 million.
With This Visa You Can
- Carry out business and investment activity in Australia.
- Stay in Australia for up to 5 years.
- Bring eligible members of your family unit with you.
- Apply for a permanent Business Innovation and Investment (Permanent) visa (subclass 888) Investor stream if certain requirements are met.

This is a provisional visa. You can stay in Australia for up to 5 years if you were invited to apply on or after 1 July 2021. If you applied after 1 July 2015, and were invited to apply for this visa before 1 July 2021, you can stay in Australia for up to 4 years and 3 months. The visa is granted with multiple entry. - For at least 1 of the 5 fiscal years immediately before we invite you to apply, have directly managed:
- A qualifying business in which you, your partner or you and your partner combined had at least 10% ownership interest, or
- Eligible investments:
- Of at least AUD 2.5 million owned by you, your partner, or you and your partner combined, if invited on or after 1 July 2021.
- Of at least AUD 1.5 million owned by you, your partner, or you and your partner combined, if invited before 1 July 2021.
- For the 2 fiscal years immediately before we invite you to apply, you, your partner, or you and your partner together, have business and personal assets with a net value of at least:
- Of at least AUD 2.5 million owned by you, your partner, or you and your partner combined, if invited on or after 1 July 2021.
- Of at least AUD 1.5 million owned by you, your partner, or you and your partner combined, if invited before 1 July 2021.
- If you were invited to apply for this visa on or after 1 July 2021, you must make (on or after the time of application for this visa), a complying significant investment of at least AUD2.5 million. You must hold complying significant investments continuously for the life of your provisional visa. It must be invested in the following proportions:
- At least AUD500,000 in venture capital and growth private equity funds which invest in start-ups and small private companies.
- At least AUD750,000 in approved managed funds. The managed funds must invest in emerging companies listed on the Australian Stock Exchange.
- A ‘balancing investment’ of at least AUD1.25 million in managed funds.
- You must:
- Have at least 3 years’ experience managing one or more qualifying businesses or eligible investments.
- Have a successful record of eligible investment or qualifying business activity.
- Have demonstrated a high level of management skill in relation to the eligible investment or qualifying business activity.
- You must score at least 65 points on the points test.
- Check how many points you might get.
- You must have a genuine intention to live for at least 2 years in the State or Territory in which you have made the investment application.
- You will not receive an invitation if you are aged 55 or older at the time of the invitation to apply for the visa. If you are older, a State or Territory might invite you to apply for this visa if your business will be of exceptional economic benefit.
- You and your partner must have had no history of involvement in business or investment activities that are of a nature that is not generally acceptable in Australia.
- All applicants aged 18 or over at the time of application must either have at least functional English or you will be asked to pay the second instalment of the visa application charge.

Significant Investor Stream (Provisional) (Subclass 188)
This provisional visa is for people who invest at least AUD5 million in Australian investments that meet certain requirements and maintain investment activity in Australia. You must:
- Be invited to apply for this visa.
- Be nominated by a State or Territory government agency or Austrade to invest at least AUD5 million that meets certain requirements and have a genuine intention to hold that investment for the life of your provisional visa.
- Have a genuine intention to live in the State or Territory whose government agency nominates you.
With This Visa You Can
- Carry out investment activity in Australia.
- Stay in Australia for up to 5 years.
- Bring eligible members of your family with you.
- Apply for a permanent Business Innovation and Investment (Permanent) visa (subclass 888) Significant Investor stream if certain requirements are met.

This visa lets holders of a Business Innovation and Investment (Provisional) visa (subclass 188) in the Business Innovation stream or the Business Innovation Extension stream, or holders of a subclass 444 (Special Category) visa, or certain holders of a subclass 457 (Business (Long Stay) visa, stay permanently in Australia. You must
- Hold, or in certain cases must have held a Business Innovation and Investment (Provisional) visa in the Business Innovation stream, a Business Innovation and Investment (Provisional) visa in the Business Innovation Extension stream, a Special Category visa, or, in some cases, a subclass 457 visa.
- Have a current nomination from an Australian state or territory government agency.
With This Visa You Can
- Stay in Australia permanently.
- Work and study in Australia.
- Enrol in Australia’s public health care scheme, Medicare.
- Sponsor your relatives to come to Australia.
- Travel to and from Australia for 5 years.

- Unless COVID-19 concessions apply, you must be the primary holder of a:
- Business Innovation and Investment (Provisional) visa (subclass 188) Business Innovation stream. If you were invited to apply for this visa on or after 1 July 2021, you must have held this visa for at least 3 years, or
- Special Category visa (SCV) (subclass 444). If this visa was granted on or after 1 July 2021, you must have held this visa for at least 3 years, or
- Business Innovation and Investment (Provisional) visa (subclass 188) Business Innovation Extension stream, or
- in certain cases, a subclass 457 visa.
- You must have a current nomination from a state or territory government agency.
- For the 2 years immediately before you apply, you must have:
- Had, and continue to have, an ownership interest in up to two main businesses in Australia.
- Had a direct and continuous management role in that business or businesses.
- Submitted Business Activity Statements to the Australian Taxation Office.
- An Australian Business Number for each of your main businesses.
- For the 24 months immediately before you apply, you must own at least:
- 51% of the total value of a business with a turnover of less than AUD400,000 per year, or
- 30% of the total value of a business with a turnover of AUD400,000 or more per year, or
- 10% of the total value of a business that is operated by a publicly listed company.
- If you bought your main business (or businesses) from a person who applied for or held:
- Business Innovation and Investment (Permanent) visa or
- A permanent business skills visa (in subclasses 890, 891, 892 or 893).
- At the time of the acquisition, you must show that you and that person co-owned the business for at least 1 year before you apply.
Your main business or businesses (or the business or businesses of your spouse or de facto partner, or of you and your spouse or de facto partner together), had an annual turnover of at least AUD300,000 in the 12 months immediately before the application was made.
- For the 12 months immediately before you apply, you or your partner (or you and your partner together) must show at least 2 of the following:
- Assets of AUD200,000 net value in your main business (or 2 main businesses) in Australia.
- Personal and business assets in Australia of AUD600,000 net value.
- Equivalent of at least 2 full-time eligible employees in your main business.
- If you want to meet the employee rule, your employees must work in your main business (or main businesses) and:
- Be Australian citizens, Australian permanent residents, or holders of valid New Zealand passports.
- Not be members of your family.
- If you want to meet the employee rule, your employees must work in your main business (or main businesses) and:
- When operating your business in Australia, you and your partner must have followed:
- Commonwealth laws.
- The laws of the states or territories where your business operated.
- You might have to pay an extra charge for any dependent applicant 18 years old or older who has less than functional English. If they can’t show that they have at least functional English, they will need to pay the second instalment of the visa application charge when asked to.

- Have a current nomination from an Australian state or territory.
With This Visa You Can
- Stay in Australia permanently.
- Work and study in Australia.

- To be granted a Business Innovation and Investment (Permanent) visa (subclass 888), you (or you and your spouse or de facto partner combined) must:
- For the whole period during which you held your Business Innovation and Investment (Provisional) visa (subclass 188), have held a ‘complying significant investment’.
- Tell us of any times you transferred funds from one investment to another.
- To be granted a Business Innovation and Investment (Permanent) visa (subclass 888), you (or you and your spouse or de facto partner combined) must:
- You must have been physically present in Australia for at least 2 years in the 3 years immediately before you apply if you are holder of a Business Innovation and Investment (Provisional) visa (subclass 188) Investor stream and you were invited to apply on or after 1 July 2021.
- You and your spouse or de facto partner must not have been involved in any business or investment activities that are unacceptable in Australia.

- Continue to hold your complying investment or complying significant investment, as required for your subclass 188 visa, during the period of that visa.
- Have a current nomination from a state or territory government agency or Austrade which has not been withdrawn.

- Business Innovation and Investment (Provisional) visa (subclass 188) granted on the basis that you were the spouse or de facto partner of a person who held a Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor stream or Significant Investor Extension stream and
- You have held this visa for at least three years if the primary visa holder was invited to apply for their Business Innovation and Investment(Provisional) visa (subclass 188) in the Significant Investor stream or Significant Investor Extension stream on or after 1 July 2021 and
- Either you have ceased to be the spouse or de facto partner of the primary visa holder or the primary visa holder has died.
- You must have a current nomination from a state or territory government agency or Austrade.
- When we granted your Business Innovation and Investment (Provisional) visa, you invested AUD5 million in a ‘complying investment’ or a ‘complying significant investment’.
- To be granted a Business Innovation and Investment (Permanent) (subclass 888) visa, you (or you and your spouse or de facto partner combined) must:
- For the whole period during which you held your Business Innovation and Investment (Provisional) (subclass 188) visa, have held a ‘complying investment’ (if your subclass 188 visa was granted on the basis of an application made before 1 July 2015) or a ‘complying significant investment’ (if your subclass 188 visa was granted on the basis of an application made on or after 1 July 2015).
- Tell us of any times you transferred funds from one investment to another.
- If any part of your investment is or was a direct investment in an Australian proprietary company, then:
- If the period of the direct investment was less than 2 years, the company must have been a qualifying business for the whole period, or
- If the period of the direct investment was 2 years or more, the company was a ‘qualifying business’ for at least 2 years, or
- If the company has been unable to operate as a ‘qualifying business’, you must have made a genuine attempt to operate the business as a ‘qualifying business’.
- To be granted a Business Innovation and Investment (Permanent) (subclass 888) visa, you (or you and your spouse or de facto partner combined) must:
Unless COVID-19 concessions apply, to be granted a Business Innovation and Investment (Permanent) visa (subclass 888), you (the primary applicant) must have held a:
- Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor stream for a continuous period of 4 years or
- Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor stream and one or more Business Innovation and Investment (Provisional) visa (subclass 188) Significant Investor Extension stream for a continuous period of 4 years or
- Business Innovation and Investment (Provisional) visa (subclass 188) in the Significant Investor stream applied for before 1 July 2015, for a continuous period of 3 years and 11 months.
- Unless Covid-19 concessions apply either:
- You must have been in Australia for at least the number of days worked out by adding the results of paragraphs (a) and (b):
- (a) 40 multiplied by the number of complete years in the period in which you held a subclass 188 visa in the Significant Investor stream.
- (b) 40 multiplied by the number of years (if any) (treating a part of a year as one year) in the period in which you held a subclass 188 visa in the Significant Investor Extension stream.
- You must have been in Australia for at least the number of days worked out by adding the results of paragraphs (a) and (b):
- You and your spouse or de facto partner must not have been involved in any business or investment activities that are unacceptable in Australia.
- You must have a realistic commitment to continuing your business or investment activities in Australia.
- If you operated a business in Australia, you and your partner must have followed:
- Commonwealth laws.
- The laws of the states or territories where your business operated.
- All applicants aged 18 or over at the time of application must either have at least functional English or you will be asked to pay the second instalment of the visa application charge.
- Meet the health requirement.
- Meet the character requirement.
- If you and your family members who have applied for the visa are 18 years of age or older at the time of application, you and your family members must:
- Have read, or had explained to you, the Life in Australia book.
- Sign an Australian Values Statement that confirms you will respect the Australian way of life and obey Australian laws.
- If you or any family members owe the Australian Government money, you or they must have paid it back or have an approved arrangement in place to pay it back.
- You might not be eligible for this visa if you have had a visa cancelled or refused while you were in Australia.
